Bluevelle Compass Beta Terms

1. Acceptance of these terms

These Bluevelle Compass Beta Terms are a binding agreement between you and Bluevelle LLC. By checking the agreement box or using Compass, you confirm that you have read and accepted these terms. If you use Compass for an organization, you confirm that you have authority to accept these terms for that organization.

If you do not agree, do not use Compass.

2. Beta planning service

Compass is an experimental planning tool. It converts information you provide into a preliminary automation blueprint. Compass does not connect to your systems, execute an automation, approve an implementation, or act as your agent.

Features, recommendations, availability, and these terms may change during the beta. Bluevelle LLC may suspend or discontinue Compass at any time.

3. No professional advice or guaranteed outcome

Blueprints are informational planning materials only. They are not legal, accounting, tax, cybersecurity, compliance, employment, financial, medical, or other professional advice. They are not implementation instructions.

Estimates of cost, time, complexity, capacity, or savings are directional assumptions. Bluevelle LLC does not guarantee that a blueprint is complete, accurate, suitable, secure, compliant, technically feasible, or capable of producing a particular result.

4. Your responsibility for implementation

You are solely responsible for deciding whether and how to use a blueprint. Before changing any system, you must obtain qualified technical, security, legal, compliance, and business review appropriate to your circumstances.

You are responsible for system backups, access controls, testing, approvals, vendor permissions, licenses, data handling, monitoring, rollback plans, and all actions performed by you or anyone acting for you. Bluevelle LLC is not responsible for an implementation unless a separate written services agreement signed by Bluevelle LLC expressly states otherwise.

5. Prohibited and high risk use

You may not use Compass to make or automatically execute final decisions involving medical diagnosis, legal rights, employment, credit, lending, insurance eligibility, public benefits, physical safety, release of funds, or similarly high impact matters without qualified and authorized human review.

You may not enter passwords, authentication tokens, payment card numbers, government identification numbers, health records, malicious code, unlawful content, or information you do not have permission to process.

6. Third party systems

A blueprint may name third party products or services. Bluevelle LLC does not control or endorse those services and is not responsible for their availability, security, pricing, licensing, data practices, changes, or failures. You are responsible for reviewing and complying with all third party terms.

7. Disclaimer of warranties

To the maximum extent permitted by law, Compass and every blueprint are provided as is and as available, without warranties of any kind. Bluevelle LLC disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, noninfringement, accuracy, security, availability, and any warranty arising from course of dealing or usage of trade.

Bluevelle LLC does not warrant that Compass will be uninterrupted, error free, secure, or free of harmful components, or that defects will be corrected.

8. Assumption of risk

You understand that AI and rules based recommendations may be incomplete, inaccurate, outdated, or inappropriate for your circumstances. You assume the risks associated with relying on, adapting, sharing, or implementing a blueprint.

9. Limitation of liability

To the maximum extent permitted by law, Bluevelle LLC and its members, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, data, goodwill, or system availability, arising from or related to Compass or a blueprint, even if advised that such damages were possible.

To the maximum extent permitted by law, the total aggregate liability of Bluevelle LLC for all claims arising from or related to Compass will not exceed the greater of one hundred United States dollars or the amount you paid Bluevelle LLC specifically for use of Compass during the twelve months before the event giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.

10. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Bluevelle LLC and its members, officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your misuse of Compass, your violation of these terms, information you submit without authorization, or your implementation or use of a blueprint.

11. Privacy and intellectual property

Our Privacy and Data Use Notice explains how Compass handles information. You retain your rights in information you provide. Bluevelle LLC retains all rights in Compass, its software, design, methods, templates, and branding.

You may use a generated blueprint for your internal business planning. You may not copy, reverse engineer, resell, or use Compass to create a competing service except where applicable law does not permit that restriction.

12. Governing law and disputes

These terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law rules. Subject to any rights that cannot be waived, the state and federal courts located in Indiana will have exclusive jurisdiction over disputes arising from these terms or Compass, and you consent to their jurisdiction.

13. General terms

These terms and the Privacy and Data Use Notice are the entire agreement concerning the beta service unless Bluevelle LLC and you sign a separate written agreement. If one provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver.

Bluevelle LLC may update these terms. Compass will request acceptance when a new version requires renewed agreement.
